変な数字ですこと

試される。さん及びWhere is a limit?さん経由、ITmedia+D LifeStyle:「iPod課金」――実現したら1台あたり400円プラス？より。文化庁文化審議会著作権分科会法制問題小委員会が9月30日に行われて、私的録音･録画補償金のパブリックコメントの中間結果なども踏まえて論点の再整理が行われたそうだ。
日本音楽著作権協会と日本芸能実演家団体協議会と日本レコード協会が「ハードディスク内蔵型録音機器等による私的録音から著作権者・著作隣接権者が受ける経済的な影響」という資料を出してきたんだけれども……これがとんだお笑い種でね。しょうもねーったらありゃしねえ。
まあ、詳しい「計算式」（そう、計算式出してきやがったのよ（笑））はリンク先の記事を読んでいただくとして、この3団体の資料を私流に要約すると

「iPod等のハードディスク内蔵型（含むフラッシュメモリ）での複製を、個別課金にしたばあいは485億円、私的録音補償金の対象に含めた場合には18億円儲かります」

という具合になる。なんつーか、この数字を出してきた意図がわからん（この計算式自体も、かなり変だけどね）。
会話にするとこんな感じだ。

「補償金が減ってきてますから、iPodなんかからもお金を取れるようにしてくださいよ」
「でも、いろいろ問題があるよねぇ」
「いや、お金を取れるようにしてもらえれば、これだけ儲かるんですってば」

説得力も何もあったもんじゃないっしょ？（笑）
金の２重取りになるんじゃないかとか、権利者が受ける不利益ってどのくらいなんだよとか、現行の制度がそもそも破綻しているんじゃないかとか、そういった問題は全部すっ飛ばして「これだけ儲かりますよ」と言われてもなあ。馬鹿にされてるんだなあ、やっぱり。
順序としてはまず、「iPod等からお金を取れなかった場合、これだけの利益の損失がでます」というのを示して、その後に「でも、iPodからもお金が取れるようになればこんな感じでその損失を埋めることが出来ます」とやらなきゃ駄目だろうに。
前者をすっとばして「これだけ儲かります」ってさ、これで誰か納得する奴いるのか？　というか、これで誰かを納得させられると思ってるのか？

うん、やっぱり馬鹿にされてるんだよ。

本来なら掲示板に書き込むなり、メールするなりで意見をお尋ねしたいのですが。
以前「トリビアの泉」で「芝刈り機の音を録音したCDが発売されたことがある」というネタが紹介されたが、これってレコード会社にその気があれば、芝刈り機のエンドユーザーもしくは芝刈り機メーカーから演奏料を取ることが可能なのでは？と、ふと思いついた次第。
愚問で失礼しました…

どもです。
凄いこと思いつきますね（笑）。法律のことはさっぱりですが、裁判に持ち込んだとしたら、芝刈り機の音の創作性は認められないだろうから著作権も認められないだろうし、芝刈り機のエンドユーザーは音で集客しようという営利目的で音を発しているわけでもないでしょうから、圧勝できるでしょうけど。でも法律にはさっぱりなんで、なんか突っ込みあったらよろ。
